Since its formation in 2003, CPAN has fought vigorously to preserve Michigan’s model auto no-fault insurance system. These efforts have included: opposing legislation that would reduce no-fault benefits and restrict victims’ rights; proposing proactive legislation that would reverse the erosion of the no-fault law that has occurred in the courts; and filing appellate court amicus curiae briefs in important no-fault cases. These efforts have resulted in many victories for patients and providers.
Make no mistake about it – the Michigan auto insurance industry will continue its efforts to break the original promise of no fault. CPAN will continue to resist these efforts by:
- opposing medical fee schedules;
- opposing managed care;
- opposing optional PIP choice;
- opposing the reduction of medical benefits;
- seeking the repeal of the Kreiner decision and the restoration of victims’ rights;
- seeking insurer “bad faith” legislation to stop unfair claim denials;
- and seeking meaningful insurance rate reform.
If CPAN did not exist, those stakeholders who want to preserve the Michigan’s model no-fault system would lose the unified force of a large, well-respected, bipartisan association that has proven it can effectively resist the political power of the Michigan auto insurance industry. CPAN has become an important voice legislators listen to regarding no-fault issues.
